Testacy or testate refers to person who left a will before they passed away. Testacy is the opposite of intestacy, which is the state of dying without leaving a valid will.
People who wish to leave wills often go to testacy proceedings at a court to establish their wills legally.
Testacy can also refer to things that are dictated by the terms of a will. For example, testate succession refers to items in a will being given out to beneficiaries as per the terms of a will. There are many items in a will that can qualify for testate succession: cash, artwork, furniture, vehicles, property, etc. The will dictates the testate succession; one person may choose to leave behind many items to family members, whereas another may wish to give many items to friends or to charity.
