Equitable Relief

Definition of Equitable Relief

Equitable relief refers to a judgment of the court that is non-monetary in nature. These types of judgments may include an order to do something (a mandamus) or an order to stop a person from doing something (an injunction).

Equitable Relief Explained

Equitable relief is often seen in court cases and settlements where a legal remedy like monetary damages can’t justify the losses.

An example of equitable relief is when a court orders the defendant to sell a piece of land in accordance with the terms of the contract in case of a contractual dispute. The property might have characteristics that monetary benefits can’t rectify.
