Definition of Execution

Execution refers to the action where a court officer takes responsibility and possession of a losing party's property on the winner's behalf, sells it, and then uses the proceedings to pay the judgment.



Execution Explained

The procedure includes taking the judgment to the clerk, which issues the writ of execution and takes it to an authorized official with the instructions on what to do with the property. However, the loser in a lawsuit may pay for the judgment from some other sources to prevent the sale of real estate.
