Definition of Tucker Act

As per the Tucker Act, there are certain kinds of claims on which the United States has waived sovereign immunity.

As per this act, the U.S. Court of Federal Claims can deliver judgment on claims against the United States. These may include claims against the Constitution, an act of Congress, etc.



Tucker Act Explained

Under the Tucker Act, claims against the government can fall into three categories:

  1. Contractual claims.
  2. Claims where the plaintiff is asking for his or her money back (money that was given to the government; also known as non-contractual claims).
  3. Another type of a non-contractual claim, where the plaintiff requests that he or she is entitled to receive some money from the government.
