Ultimate fact may be defined as the conclusion of a fact (in a trial setting), which has been deduced from evidence on logical grounds. This evidence is also known as evidentiary facts.
In order to prove the ultimate fact, it is important to put forward the evidentiary fact in court. A statement by the witness is not enough to prove an ultimate fact.
Ultimate and evidentiary facts can be explained with the following example:
A person exceeded the speed limit, the person also drove over a double line, and then finally lost control of their vehicle, skidding and bumping into something. These evidentiary facts will prove the ultimate fact that the driver was in fact negligent.
