Definition of Aggravated Assault

Aggravated assault is much like aggravated battery in that it is an assault that is considered more serious in nature than a common assault due to one or more factors. Most states do not even make a distinction between the two terms, but in those that do, it comes down to the relationship of the person to the victim, their status in society, and the facts surrounding the case. Aggravated assault is a felony that carries up to 20 years of incarceration.



Aggravated Assault Explained

Assault in itself does not have to include actually touching a person. To be considered assault, there only needs to be a person fearing that something is going to happen to them. If it leads to the person being physically touched, it is treated more severely. Even a mutual fight can end with both sides being charged with aggravated assault.
