Definition of Notorious Possession

Notorious possession refers to when an individual who does not own a piece of land takes possession of that land in such a way that allows the true owner to become aware that somebody else has taken possession of the land. In other words, notorious possession gives others notice that somebody has taken possession of the land.



Notorious Possession Explained

Notorious possession is almost always referred to when dealing with the various laws of adverse possession. In order for an individual to prevail in an adverse possession case, the individual must prove the elements of an adverse possession case. Most jurisdictions contain five elements that must be proven when dealing with adverse possession. One of these five elements that must be shown is that the individual has notorious possession of the real property in dispute.
