Definition of Willful Tort

A willful tort is a harmful act that is undertaken for the purpose of causing intentional harm to physical property. If a person were to intentionally damage another person's vehicle for the intent of breaking it, that person could be charged with a willfull tort. In most willful tort cases, the fine is remediary and is intended to repair the damage caused. Punitive damages can be gained in a willful tort case for loss of opportunity and the emotional stress that was caused by the tort.
