Definition of Split Custody

Split custody is a legal term used to describe the custody of minor children within a divorce or separation, where there is more than one child and the children are split up between the parents. Basically, one parent takes custody of a child or children, and the other parent takes custody of the rest of the children.



Split Custody Explained

Split custody is given when both parties are in agreement, because it is not often court-ordered to break up siblings. If the parents determine that they would prefer to split up the children between them, then the court will abide by their mutual consent on the issue. There are times where a court will uphold the request by one parent for split custody.
