An abatable nuisance is a type of a problem or nuisance that can be easily removed; for example, when there is an interference that prevents the right to enjoy and use the land. This type of interference may be intentional, unintentional, hazardous or negligent in nature.
A lawsuit may be filed if the nuisance interferes with another person’s right to use his or her property. The process of abating the nuisance may involve the removal of the nuisance, rehabilitation, repair or even demolition. An abatable nuisance is not of a permanent nature.
